THE 2023 PHOTO CONTEST RULES

Who May Enter

Entrants must be verifiable Fencing Direct customers. All entrants and winners must be 21 years of age or older. Employees of Fencing Direct, subsidiaries, affiliates; advertising and promotion agencies, and immediate family members of each are not eligible. Only one entry per product per household is allowed.

How To Enter

Send your best color photos of your fence, railing, pergola, etc. by emailing your photo and comments to sales@fencingdirect.com, following the instructions below and we will post it for you.  Only photos of projects using Fencing Direct products are allowed.

Projects must include any type of product sold by Fencing Direct in a residential setting. We're looking for photos that show how our products have beautified or transformed your yard, deck, or porch, or photos of our products being used in fun and creative ways.

Minor digital enhancements for cropping and red-eye removal are permitted, but images judged to be significantly altered will be disqualified. Photographers are not permitted to place borders or frames around their images or to place watermarks, signatures, dates or copyright notices on their images. Images must maintain the integrity of a proper product installation and will be judged accordingly. The products shown in the photos must have been purchased from Fencing Direct.

When To Enter

The contest ends May 15^th, 2023 at 11:59 AM EST All submissions must be submitted and received by the deadline.

Rules for Digital Submissions

Shoot the original photographs in the highest resolution possible, 1 meg (or larger), at 300 dpi resolution. All prize winners will be asked to submit a copy of the original high-resolution file. It is necessary that each filename identify the photographer and type of Fencing Direct product. Please rename your images to include the following: Product, Photographer's Last name Example: "railing-james.jpg" or "fence-smith.jpg.” By posting your submission and entering the Contest, you certify that you have read all of the Official Contest Rules and accept and agree to be bound by these rules and the decisions of Fencing Direct, which shall be final, binding, and conclusive on all matters. All entries and photographs become the exclusive property of Fencing Direct and will not be returned or acknowledged.

Fencing Direct will not be responsible for lost, delayed, damaged, misdirected, or illegible submissions or any computer, telephone, cable, network, electronic or Internet hardware or software malfunctions, failures or unavailability. The Contest is void where prohibited, taxed or otherwise restricted by law.

Prizes

Grand Prize: A $500 Money Card

1^st Place Prize, one winner for each category: A $250 Money Card

2nd Place Prize, one winner for each category: A $150 Money Card

3rd Place Prize, one winner for each category: A $75 Money Card

All prizes are non-transferable and voided where prohibited by law. All major prizes will be given away by Fencing Direct. The odds of winning a prize will depend on the number of qualified entries. Fencing Direct may substitute another prize of equal value, in the event of the non-availability of an announced prize. No cash substitution of prizes allowed.

Judging

Judging will be conducted by Fencing Direct’s Employees. Judging criteria will include (1) the relevance of the photo entry depicting the requirements for the categories. (2) Originality. (3) Overall scope of the project.

Winners

The prize winners will be notified via email and announced on Facebook and Instagram within 30 days of the end of the Contest. At that time, they may be asked to submit an original digital file (digital files should not be less than 300 dpi and 1 meg). Please allow 8 to 10 weeks after the Contest has ended for prizes to be delivered. Prizes may be mailed either first-, second-, or third-class U.S. Mail, at the discretion of Fencing Direct. If the prize is to be mailed, it is the responsibility of the winners to provide Fencing Direct with a current and correct mailing address. Fencing Direct is not responsible for the failure or tardiness of prizes delivered via the US Postal Service; nor obligated to replace any lost, stolen, or damaged prize delivered via US Postal Service. Proper identification (valid driver's license, passport, state ID, military ID) may be required, for registered mail.

Winners' photos and names will be posted on the appropriate Fencing Direct website within 60 days of the end of the Contest and certain non-winning photos may also be posted. Prizewinners may be required to execute an Affidavit of Eligibility/Originality and Publicity/Liability Release. All required documentation must be returned within 14 days from the date appearing on the letter of notification or the prize will be forfeited.

Winners will be responsible for paying any taxes they may owe on a prize. In the event of non-compliance with these requirements, the prize will be forfeited and the entry with the next highest score will be declared the winner. Fencing Direct reserves, the right to disqualify entrants and/or cancel or suspend the Contest should unauthorized intervention or other causes corrupt the administration, security, fairness, integrity or proper operation of the Contest.

Rights to Photograph

An entrant must hold all rights to the photograph that is submitted. Submission of an entry grants Fencing Direct and its affiliated companies the unrestricted right to modify, edit, adapt, alter, publish and/or use the submitted photograph in any way, at any time, and in any and all media in connection with the advertising or promotion of Fencing Direct's products or services, without consideration or payment to the entrant or to any other third party. At its discretion, Fencing Direct also reserves the right to include the name of the entrant and the city and state where the photo was taken in any and all such above-described advertising and promotional activities. Specific addresses will not be disclosed.

The entrant represents that any person depicted in the photograph (or, if a minor, the minor's parent or guardian) consents to Fencing Direct’s use of the photograph in accordance with these Official Rules. The entrant is solely responsible for obtaining necessary authorizations (e.g. model release forms, etc.) from the person(people), the parents, or legal guardians of minors, and the owners of all private property and trademarks appearing in the photograph to take the photograph and to grant Fencing Direct the rights herein granted. Entrant further represents that the photo does not infringe or violate any third-party rights.

Release of Liability

All entrants release Fencing Direct and each of Fencing Direct's affiliates, subsidiaries, officers, directors, agents, employees, and all others associated with the development and execution of this Contest, from any and all liability with respect to, or in any way arising from, this Contest, and/or use of the prizes, including liability for personal injury. Fencing Direct is not responsible for printing, production, typographical errors, or omissions, or other similar errors or omissions.

By sending your submission and entering the Contest, you certify that you have read all of the Official Contest Rules and accept and agree to be bound by these rules and the decisions of Fencing Direct, which shall be final, binding, and conclusive on all matters. All entries and photographs become the exclusive property of Fencing Direct and will not be returned or acknowledged.
